Care Bears Jellybean Experience Terms of Use

1. Description of the Experience

The Experience delivers post-purchase and open-access Care Bears digital content (QR unlocks, microsites, social integrations, collectibles, engagement tracking, rewards, messaging, etc.).

2. Eligibility

Intended for users 13+.
If you're under the age of majority in your jurisdiction, you must have parental/guardian consent.
You represent that you meet these requirements.

3. Accounts and Access

Certain features require passwordless login (Magic Link). Keep your login link secure and notify us of suspicious activity.
We may suspend or terminate access for violations or legal/business requirements.

4. Acceptable Use

You agree not to:

Use the Experience unlawfully or fraudulently.
Submit infringing or privacy-violating content.
Interfere with operations or security.
Circumvent protections, scrape, or automate access without permission.

5. User Content

You retain ownership but grant Jellybean a worldwide, royalty-free, sublicensable license to host, display, and adapt content for operation of the Experience.
You confirm you have necessary rights to what you submit.

6. Intellectual Property

All Experience content is owned by Jellybean/BOP Labs or licensors.
You receive a limited, non-transferable license for personal use only.

7. Third-Party Services

Authentication via Magic Link; blockchain-backed experiences via third-party infrastructure providers; subject to their policies.
Providers may change without notice.

8. Data and Privacy

Governed by the Care Bears Jellybean Privacy Policy (email, geolocation, engagement metrics, purchase info for 13+ users, etc.).
GDPR/COPPA compliant with global coverage.

9. Disclaimers

Provided "AS IS" and "AS AVAILABLE" without warranties; no guarantee of uninterrupted access or specific outcomes.

10. Limitation of Liability

To the extent permitted by law, Jellybean/BOP Labs are not liable for indirect or consequential damages. Aggregate liability capped at US$100 or amounts paid in the prior 12 months.

11. Indemnification

You agree to indemnify Jellybean/BOP Labs/Care Bears licensors from claims arising from misuse or rights violations.

12. Suspension/Termination

We may suspend/terminate service at any time. Provisions intended to survive (IP, disclaimers, liability, indemnity, governing law) remain in effect.

13. Modifications

Updates become effective upon posting with a new "Last updated" date.

14. Governing Law & Dispute Resolution

Governed by Ontario law and applicable Canadian federal law.
Disputes go to binding arbitration in Toronto unless mutually agreed otherwise.
No class actions or class arbitrations.
